Terms of Service

1.1 These Terms of Service constitute a legal agreement between you and the OBOQ Platform regarding the use of this Platform's services. When using the various services provided by this Platform, you must comply with these Terms and any supplementary terms, platform rules, etc.

1.2 The Platform reserves the right to modify these Terms as needed. Modified Terms will be published on the Platform and take effect immediately upon publication. You should regularly review the Terms to ensure you are aware of the latest content. If you continue to use the services after the Terms have been modified, you accept the modified Terms.

1.3 If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. In such case, "you" and "your" will refer to that entity.

1.4 The Platform reserves the right to modify, suspend, or terminate services at any time without prior notice. The Platform shall not be liable for any modification, suspension, or termination of services.

2.1 To use the Platform services, you may need to register an account. You agree to:

• Maintain and promptly update registration information to keep it true, accurate, complete, and up-to-date
• Assume full responsibility for all activities under your account
• Immediately notify the Platform of any unauthorized account use or security breaches
• Ensure you log out of your account to prevent unauthorized access, especially when using shared devices

2.2 You must be at least 18 years of age or the age of majority in your jurisdiction to register and use the Platform services.

2.3 You are responsible for maintaining the confidentiality of your account information (including passwords). The Platform shall not be liable for any loss or damage arising from your failure to protect your account information.

2.4 The Platform reserves the right to refuse registration, suspend, or terminate accounts for the following reasons:

3.4 Third-Party Services: The Platform may include or provide access to third-party websites, services, or resources. The Platform is not responsible for such third-party content and does not endorse or guarantee its accuracy. Your use of any third-party services or resources is at your own risk.

4.1 When using the Platform services, you agree to comply with all applicable laws, regulations, and these Terms. You may not use the services for any unlawful purpose or in any unlawful manner.

4.2 Prohibited conduct includes but is not limited to:

4.3 Content Responsibility: You assume full responsibility for any content you post, transmit, or display through the services. The Platform does not pre-screen user-generated content but reserves the right to remove or refuse any content at its sole discretion at any time.

4.4 Platform Monitoring: The Platform reserves the right to monitor service usage to detect, prevent, and respond to fraud, abuse, security, or technical issues. The Platform may collect and use relevant information for these purposes.

5.1 Platform Content Ownership: The Platform and all its content, features, and services (including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software) are the property of the OBOQ Platform or its content providers, protected by international copyright laws and related laws.

5.2 The Platform grants you a limited, non-exclusive, non-transferable, revocable license to access and use the services solely for your personal use, provided you comply with these Terms. This license does not include the right to:

• Resell or commercially use the services or content
• Collect or use any listings, descriptions, or prices
• Make any derivative use
• Download or copy account information (except as necessary for normal use)
• Use data mining, robots, or similar data gathering and extraction tools

5.3 User Content License: By posting, uploading, inputting, providing, or submitting content on the Platform, you grant OBOQ Platform a worldwide, royalty-free, non-exclusive, transferable, sublicensable right to use, copy, modify, adapt, publish, translate, publicly display, and distribute your content for the purpose of providing and improving services.

5.4 Trademarks: OBOQ, OBOQ.com, Platform logos, and all related names, logos, product and service names, designs, and slogans are trademarks of OBOQ Platform or its affiliates. You may not use these trademarks without prior written permission.

5.5 Intellectual Property Complaints: The Platform respects others' intellectual property rights. If you believe your content has been copied in a way that constitutes copyright infringement on the Platform, please file a complaint according to our copyright policy.

6.1 Services Provided "As Is": The Platform and its content and services are provided on an "as is" and "as available" basis, without any express or implied warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, ownership, and non-infringement.

6.2 Information Accuracy: The Platform strives to provide accurate and up-to-date real estate information but does not guarantee the accuracy, completeness, reliability, or timeliness of all information. Real estate information may change at any time, and the Platform has no obligation to update information.

6.3 Third-Party Content Disclaimer: The Platform may contain content, links, or references provided by third parties. The Platform is not responsible for the accuracy, completeness, or reliability of such third-party content. Your access to or use of any third-party websites, services, or content is at your own risk.

6.4 Service Continuity: The Platform does not guarantee uninterrupted, timely, secure, or error-free services. The Platform does not guarantee that any results obtained through the services are accurate or reliable. The Platform may suspend services for maintenance, upgrades, or other reasons.

6.5 Technical Issues: The Platform shall not be liable for any damages caused by technical issues, viruses, hacking, system failures, or other force majeure events.

6.6 User Decision Responsibility: Any real estate-related decisions you make based on Platform information (including but not limited to purchases, sales, leases, investments, etc.) are made at your own risk and responsibility. The Platform does not participate in actual transactions and assumes no responsibility for transaction outcomes.

7.1 In no event shall OBOQ Platform, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the services
• Any goods, data, information, or services purchased or obtained through the services
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party in the services
• Any other matter related to the services

7.2 The above limitation of liability applies even if the Platform has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

7.3 The Platform's total liability (whether based on contract, tort, or other theory) shall not exceed the amount you have paid to the Platform for using the services in the past 12 months (if any). If the Platform has not charged you any fees, the Platform's liability to you shall be limited to USD 100.

7.4 The Platform shall not be liable for:

8.1 Governing Law: These Terms are governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles.

8.2 Dispute Resolution: Any dispute arising from or relating to these Terms shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party has the right to submit the dispute to the competent People's Court in the location of the Platform's operating company for litigation resolution.

8.3 Severability: If any provision of these Terms is deemed invalid or unenforceable, that provision shall be limited or excluded to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

8.4 Assignment: You may not assign these Terms or transfer any of your rights or obligations without the Platform's prior written consent. The Platform may assign these Terms with notice to you.

8.5 Entire Agreement: These Terms (including other policies the Platform may issue) constitute the entire agreement between you and the Platform regarding the use of the services and supersede all prior or contemporaneous oral or written agreements, understandings, and representations.
